Terms of Service

The short version

1. These terms

These terms are an agreement between you and Audrow Nash LLC (“we”, “us”), who operates Common Ink at commonink.app. By using Common Ink you agree to them and to our Privacy Policy. If you use Common Ink for an organization, you agree on its behalf.

2. Your account

You need to be at least 13 to use Common Ink, and you sign in with a Google account. Keep that account secure: you're responsible for what happens under your sign-in. Tell us right away at support@commonink.app if you think someone else has access.

3. Your content

You keep ownership of the notes, files and other content you put in Common Ink. You give us permission to store, copy, process and display it only as needed to run Common Ink for you and the people you share it with, for example to index it for search, render previews and keep its history. You're responsible for having the rights to what you upload.

You can connect AI agents and other apps to Common Ink. They act with your access, and their changes are recorded under their name. You're responsible for what they do on your behalf. Their providers' terms apply to your use of them.

We may remove content or suspend accounts that break these rules. To report content, including copyright infringement, email support@commonink.app.

7. Links, embeds and other services

Common Ink can show previews and embeds from other sites (such as YouTube or social networks). We don't control those services and aren't responsible for their content. Their terms apply when you use them.

8. Price

Common Ink is currently free. If we introduce paid plans, we'll tell you in advance, and you'll never be charged unless you choose a paid plan.

9. Changes and availability

Common Ink is a new service and will change: we may add, change or remove features. We work to keep it available and your data safe, but we can't promise it will always be available or free of errors. Your notes are plain markdown, so it's easy to keep your own copies of anything important, and we recommend that you do.

10. Ending your use

You can stop using Common Ink at any time and ask us to delete your account. We may suspend or end your access if you break these terms, if you create risk or legal exposure for us or others, or if we stop offering the service. Where we reasonably can, we'll give you notice and a chance to export your content first.

11. Disclaimers

Common Ink is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. You're responsible for checking any content, including content written by agents, before you rely on it.

12. Limitation of liability

To the extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue. Our total liability for any claim about Common Ink is limited to the greater of US$100 and the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

13. Changes to these terms

If we make material changes, we'll tell you in the app or by email at least 14 days before they take effect. If you keep using Common Ink after that, you accept the new terms.

14. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the courts located there, unless the law where you live gives you the right to bring them elsewhere.
